Summary of Position
The owner of 53 Oxford Street in the City centre informed the City council as local planning authority of their intention to clear the site by submitting a prior notification of proposed demolition application. The Council, as the local planning authority, had 21 days to determine this application, which expires on 8th June 2015.
As Local Planning Authority, the City Council decided to remove the permitted development rights which would allow demolition of the properties and on 2nd June 2015 served an immediate Article 4 Direction which means that submission of an application for planning permission would now be required to demolish the buildings.
The decision to make an Article 4 Direction was made under powers delegated to the Director of Planning, Transportation and Economic Development on 27th May 2015. The Direction itself can be found at this link and will apply for a period of 6 months. In order for the Direction to remain in place beyond this period, the City Council would need to confirm the Direction in line with the provisions of the relevant legislation.
