Statement of Licensing Policy 2026

Overview

A Statement of Licensing Policy sets out how Leicester City Council, as the Licensing Authority under the Licensing Act 2003, will exercise its licensing functions.

The policy provides guidance to applicants, licence holders, responsible authorities, businesses, residents and other interested parties on matters relating to the licensing of the sale and supply of alcohol, regulated entertainment and late-night refreshment.

The Licensing Act 2003 requires licensing authorities to review and publish their Statement of Licensing Policy at least every five years. Leicester City Council has therefore undertaken a review of its current policy to ensure it remains up to date, reflects current legislation and national guidance, and continues to support the promotion of the four licensing objectives.

What is proposed / what has changed

The revised draft policy retains the existing principles of the current policy but includes a number of updates to reflect legislative changes, revised national guidance and local priorities since the previous policy was adopted.

Key changes include:

  • Updated references to current legislation and the latest Home Office Guidance issued under Section 182 of the Licensing Act 2003.
  • New guidance recognising the Terrorism (Protection of Premises) Act 2025 (Martyn's Law) and clarifying its relationship with the Licensing Act 2003.
  • Updated guidance for applicants in relation to operating schedules, public safety and risk assessments.
  • Clarification of the Council's approach to Temporary Event Notices, public safety and partnership working.
  • Updated local demographic information, evidence and references to current council strategies and supporting documents.
  • General amendments throughout the policy to improve clarity, reflect current legislation and ensure consistent decision making.

The proposed policy does not introduce new licensing objectives or fundamentally change the Council's approach to licensing. Instead, it updates and strengthens the existing policy to ensure it remains effective, proportionate and fit for purpose for the next five years.
