We asked for your comments and level of support for our proposed Public Space Protection Order (PSPO) for the continuation of street drinking. This will give police additional powers to enforce restrictions, (and in some cases make arrests) where people are displaying anti-social behaviour while drinking.
You said
Of the 810 respondents;
a) 86.17% think street drinking continues to be an issue in Leicester
b) 48.52% had a problem with street drinkers
c) 36.91% stated that there was a problem with groups of street drinkers
d) 26.42% experienced problems with street drinking every day
e) 25.19% think current order has helped in dealing with street drinking
f) 89.51% support the continuation of a citywide street drinking order
Specific problems experienced by respondents were:
• 36.67% littering
• 35.06% intimidation
• 39.51% noise
• 35.43% verbal abuse
• 15.19% physical abuse

We are considering the continuation of the street drinking order in light of the fact that 89.51% of the respondents have stated their support.
Overview
We are consulting to gauge whether anti-social behaviour around street drinking is an issue for the public. Your views will help us decide whether to continue the city wide Public Spaces Protection Order (PSPO) which can be used to control street drinking and any related anti-social behaviour.
Why your views matter
Leicester currently has a citywide Public Spaces Protection Order (PSPO) around street drinking, which was established in January 2015 and will end in December 2017. The PSPO gives police extra powers to deal with anti-social behaviour related to street drinking.
We are consulting to seek the views of residents and communities of Leicester on the continuation of the current Public Spaces Protection Order (PSPO) around street drinking.
PSPOs last for a maximum of three years and now community consultation is required to determine how much public support there is to continue with the current street drinking order to deal with anti-social behaviour related to street drinking within the city.
A PSPO is not an outright ban on street drinking. It is not an offence to consume alcohol in a public space; the offence is failing to comply with an officer’s request to stop drinking or failing to surrender the item. The Police can make an arrest for street drinking related to anti-social behaviour.
Purpose
Public Spaces Protection Orders (PSPOs) are intended to deal with a particular nuisance or problem (in a specified area) that is damaging the local community’s quality of life by imposing conditions on the use of that area which apply to everyone. They are designed to ensure that the law-abiding majority can use and enjoy public spaces, safe from anti-social behaviour.
The continuation of PSPO around street drinking will;
- Allow council and police officers to continue to take action to protect our communities under the existing legal framework.
- Allow police officers to make an arrest for any anti-social behaviour related to street drinking.
- Give officers the tools to tackle on-street alcohol consumption.
- Give greater control to deal with street drinking where it is problematic, especially in parks/open areas citywide.
